The following terms apply to the Delphis Association website under the domain delphis.ngo, and to all information and content therein, including images, videos, articles, and services (the “Website”).

By accessing this Website, you confirm that you have read, understood, and agreed to act in accordance with these Terms of Use. If you do not understand or agree to these terms, you must immediately leave the Website and refrain from making any use of it.

Delphis may modify these Terms of Use from time to time, at its sole discretion and without prior notice.

Any use of masculine and/or singular language in this document shall also refer to feminine, plural, and legal entities or corporations, as applicable.

1. General

You are visiting the Delphis Association website (the “Website”), operated by third parties, employees, and volunteers of Delphis, and serving as the official website of the Association.

The Association was established for the benefit of marine mammals in Israel, with the goal of protecting and conserving them and the marine environment, through public awareness, education, outreach activities, and the promotion and expansion of marine protected areas in Israel.

The Website is operated by Delphis Association (Registered Nonprofit No. 580702017) (the “Website Operators”) under the domain name www.delphis.ngo. These Terms of Use constitute a legally binding agreement between Website users and the Website Operators.

You are requested to read these Terms before browsing the Website. Browsing the Website, whether registered or not, and/or any other activity conducted on the Website, constitutes acceptance of these Terms in their most recent version published on the Website. These Terms constitute a legally binding agreement governing the relationship between the parties.

It is hereby clarified that:

• You may not copy, modify, or display the name, logo, and/or trademarks of Delphis or third parties/the Website in any way, nor include any trademark or logo of Delphis as a meta-tag, hidden text, or any other mark that may create the impression of affiliation, sponsorship, or endorsement between you and Delphis and/or any third party.

• You may not print, copy, modify, distribute, publicly display, reproduce, publish, license, create derivative works from, rent, assign, transfer, pledge, or sell any part of the Website, including images and videos, or any of your rights under these Terms.

• You may not modify, reverse engineer, decompile, or attempt to access the source code of the Website or create derivative works.

• You may not use framing technology to display any content from the Website.

• You may not infringe contractual or proprietary rights, including intellectual property rights of the Association or third parties.

• You may not provide false information or use the Website in a way that harms or may harm (including defamation) the Association, its employees, related parties, other users, or any third party.

• You must refrain from uploading materials containing viruses, trojans, or harmful code.

• You may not use automated tools such as bots, crawlers, worms, or other robotic means to access the Website.

• You may not use the Website for unlawful purposes or in violation of Israeli law.

• Third parties are not authorized to use the Website for profit-making or commercial purposes.

The Website is designed for all ages. However, activities operated by the Website Operators—including purchases and tour registrations—are limited to persons aged 18 and above with legal capacity, or minors accompanied by or authorized by their parents/guardians.

The right to use the Website is personal and may not be transferred.

2. Intellectual Property and Ownership

The Website and all texts, learning materials, logos, graphics, software, trade names, designs, images, videos, audio clips, databases, improvements, derivative works, and all intellectual property rights related thereto (“Delphis Property”) are the exclusive property of Delphis and/or its licensors.

These Terms grant you only a limited right to use the Website. Any copying, modification, commercial use, reuse, or distribution of Delphis Property is strictly prohibited without prior written consent.

“Intellectual Property Rights” include worldwide rights in:

• Copyright and related rights

• Trademarks, service marks, logos, domain names, goodwill

• Any similar proprietary rights in intangible property

The Association may redesign or modify any aspect of the Website at any time.

If passwords are provided, you are solely responsible for maintaining their confidentiality.

The Website is provided “as is”, without warranties of any kind. The Website Operators assume no responsibility regarding technical performance, suitability for specific purposes, accuracy, reliability, or results from use of Website content.

3. Purpose of the Website

The Website reflects the Association’s mission to protect marine mammals and the marine environment. It serves as a technological platform connecting individuals, organizations, and initiatives, and promoting awareness and conservation efforts in Israel and globally.

Content may include educational materials, videos, images, academic articles, survey results, observations, reported sightings, an online store, informative materials, and links to external sites and social media.

4. Registration

To order products or subscribe to the newsletter, users must register via an online form.

Users must have legal capacity and a valid credit card (Visa or Isracard).

Registration is one-time. Users must provide accurate details and are responsible for maintaining updated information.

The Website may request additional identification or password updates.

The Website may block access, temporarily or permanently, in cases including:

• Illegal acts

• Violation of these Terms

• False information

• Disruption of Website operations

• Blocked or restricted credit card

5. Purchase of Products

Products are ordered by adding them to the shopping cart and completing the online form.

Accurate details must be provided. Orders are confirmed only after payment authorization via credit card or PayPal and subject to product availability.

The Website is not responsible for payment service providers. Any payment issues must be addressed directly with them.

6. Delivery

Delivery occurs after payment confirmation.

Estimated delivery:

• Up to 14 business days (registered mail)

• Up to 7 business days (courier)

Business days exclude Fridays, Saturdays, holidays, and holiday eves.

Shipping fees apply and are displayed during checkout.

The Website is not responsible for delays due to force majeure or postal service delays.

7. Order Cancellation

Cancellations must comply with the Israeli Consumer Protection Law.

Refunds will be issued minus cancellation fees (5% or 75 NIS, whichever is lower), excluding shipping. No fee applies in case of defect or non-conformity.

8. Liability

The Association is not responsible for damages related to product repair, installation, or replacement.

The Association is not responsible for external website content accessed via links.

The Website is provided without liability for damages arising from its use.

9. Data Collection & Citizen Science

The Association operates a marine data collection system including reports from researchers and citizens.

Users are encouraged to report marine mammal sightings truthfully and provide supporting media when possible.

Reports are reviewed by researchers before being added to the database.

Submitting data grants the Association permission to use it for research purposes.

False reports may result in blocking access.

10. Dolphin and Sea Center Tours (Ashdod)

Tours require advance ticket purchase.

The Center is located within the ORT Ashdod Maritime School premises and access requires coordination.

Minimum participants: 15.

Children aged 5–10 must be accompanied by an adult.

The Center is not fully wheelchair accessible. Visitors with disabilities should notify in advance.

11. Privacy Policy

Personal details are stored in the Association’s database and used only for completing transactions or services.

Payment details are processed by a clearing company and are not stored by the Association.

Information may be disclosed in cases of legal obligation or unlawful activity.

Cookies may be used for operational, statistical, personalization, and security purposes.

Absolute security cannot be guaranteed.

12. Indemnification

You agree to indemnify and hold Delphis harmless from any damage, loss, or expense arising from your use of the Website or violation of these Terms.

13. Future Ownership Changes

If the Website merges or transfers ownership, stored information may be transferred subject to this Privacy Policy.

14. Limitation of Liability

The Association shall not be liable for direct, indirect, incidental, or consequential damages resulting from Website use or inability to use it.

15. Governing Law and Jurisdiction

These Terms are governed exclusively by Israeli law.

Exclusive jurisdiction lies with the courts of Tel Aviv–Jaffa.

16. Miscellaneous

This agreement grants no rights to third parties.

Headings are for convenience only.

The Website may be suspended or closed at any time.

Internet disruptions may occur beyond the Website Operators’ control.

17. Entire Agreement

These Terms of Use, together with the Privacy Policy, constitute the entire agreement between you and Delphis regarding the subject matter herein. They may only be amended in writing or as updated by Delphis on the Website.
